Introduction

 

United Community Services of Greater New York, Inc. (“Company”) has created this Privacy Policy (“Policy”) to demonstrate the Company’s firm commitment to the privacy of the users of our website, http://www.ucstrustservices.org (“Site”).  The Site is intended to be a safe environment for anyone who uses or accesses the Site or transmits, posts, or receives information, including (without limitation) numeric, financial, and other information in spreadsheet, graphical, textual, animated, still images, video, visual, aural, and any other format (“Content”).

 

THIS POLICY IS A LEGAL AND BINDING AGREEMENT BETWEEN YOU AND THE COMPANY governing your use of this Site, and our privacy practices with respect to the Site. Please review this Policy fully before you continue to use the Site.  By using and accessing the Site, you agree to be bound by this Policy.  You will also be subject to any additional terms posted with respect to individual sections of the Site, which also govern your use of, and access to, the Site.  These additional terms include (without limitation) the Terms and Conditions of Internet Service.

Collection of Information About You

 

When you use or access this Site, the Company automatically tracks certain information about you. This information includes your domain name and IP address, your browser version, your operating system and version, the dates and times that you access the Site, the name and URL of the website or search engine site that you visited prior to landing at this Site, the webpages that you visit within this Site, links that you view, and the name and URL of the Website to which you go upon leaving the Site (collectively, the “Tracking Information”).  The Company reserves the right to use the Tracking Information, in an aggregated form only, to monitor and evaluate the Site’s performance, utilization of features and services, traffic trends, and users’ selections of browser versions.

We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets (including through bankruptcy).

 

Registration and Passwords

 

Access to many pages on this Site is limited to registered users.  In order to register, you will be required to select a unique password.  You agree not to disclose your user name and your password to others.  You are solely responsible for maintaining the confidentiality of your user name and your password. You will be responsible for all consequences and damages arising from all uses of your registration for this Site, whether or not authorized by you.  You agree to notify the Company immediately about any unauthorized use of your registration or password.

 

The Company strives to protect the personal information, confidentiality, and privacy of each user.  However, the Company cannot (and does not) guarantee the security of any personally identifiable information or Content that you disclose online (via the Site or otherwise), or submit to the Company in connection with your registration on, use of, or access to this Site (or otherwise), and you do so entirely at your own risk.

 

Mobile  Device Users

 

You can use this Site and access your account with the Company by using virtually any mobile device (such as a tablet, smartphone, or wearable device) that has an Internet browser application (“Mobile Website”).  In order to use our Mobile Website, you must have an active account, and have a valid username and password. There is no charge to use our Mobile Website. However, you may not be able to access or use our Mobile Website unless you subscribe, or have access, to a mobile communications network. You are responsible for any service fees associated with such access (including text messaging and any data that you send and receive to, from and via our Mobile Website on your mobile device, as applicable). The Company cannot and does not assume responsibility for any technical or other difficulties that you may incur that relate to your use of a mobile device or your mobile communications network.

 

When you use our Mobile Website, the Company may receive information about your geographic location, your mobile device, and your mobile network, all of which may be used for the Company’s business purposes. This information may also include the Tracking Information described above.

 

Most mobile devices allow you to control and disable location services and Cookies. Please refer to the instructions for your mobile device for information about controlling these and other settings.  You understand that there are many risks associated with using a mobile device, and that in the event of theft or loss of your device, or improper accessing of your mobile network, your confidential information could be compromised.  In case your mobile device is lost, stolen, or compromised, you agree to change your account username, password, and other access information, and to disable the use of your mobile device. It is your sole responsibility to maintain the confidentiality of your user name and password, to monitor any and all activities that occur with respect to your account, and to notify us immediately about any unauthorized use of your account.

 

Our Mobile Website is provided to you “AS IS” and without any warranty, express or implied. Not all features of the Site may be available on the Mobile Website.  The Company reserves the right to change, suspend or discontinue the Mobile Website and/or your use of the Mobile Website, in whole or in part, immediately and at any time without prior notice to you.  Your use of, and access to, the Mobile Website will be subject to this Policy and all of the other operating rules and terms that are posted on the Site, including, without limitation, the Terms and Conditions of Internet Service.

 

Risks

 

You acknowledge that you are aware of the numerous security and privacy limitations relating to accessing a website, including but not limited to: (1) the global accessibility of this Site on the Internet; (2) the limitation of security, privacy, and authentication measures and features in this Site; (3) the risk that data or information on this Site may be subject to eavesdropping, sniffing, spoofing, forgery, spamming, “impostering”, tampering, breaking passwords, harassment, fraud, electronic trespassing, hacking, nuking, system contamination (including viruses, malware, worms, and Trojan horses) causing unauthorized, damaging, or harmful access and/or retrieval of information and data on your computer; and (4) the risk that data or information on this Site may be subject to other security or privacy hazards, may not reach its destination, or may reach an erroneous address or recipient.

 

Children

 

The Company is committed to the safety of children and to protecting the online privacy of children.  Children under 18 may not use this Site.  The Company does not and will not request or knowingly collect from a child any personal information about the child or child’s family.  The Company is not able to prohibit minors from visiting this Site.  The Company relies on parents, guardians, and those responsible for supervising children under the age of 18 to monitor their children’s use of the Internet and to ensure that their children do not use or access this Site.

 

General Legal Terms

 

You and the Company have agreed to this Policy within the State of New York, for all purposes.  All services that are furnished to you on (or through) the Site are deemed to be furnished by the Company to you within the State of New York.  All such services are being furnished by the Company through its personnel and computer equipment located within the State of New York.

 

All disputes arising out of, under, or in connection with this Policy (including without limitation, their validity, interpretation, performance, or breach) will be adjudicated exclusively in the federal or state courts located in  (or having jurisdiction over) New York County, New York.  You expressly consent to the jurisdiction of such courts over you.  You expressly waive any claim of forum non conveniens.  You agree to reimburse the Company for its legal fees and expenses of instituting (or defending) a lawsuit by (or against) you.  This Policy and its validity and effect will be interpreted under, and governed by, the laws of New York, without regard to its conflict of laws provisions.

 

This Policy (and any other operating rules or terms posted on the Site, including, without limitation, the Terms and Conditions of Internet Service) constitute the entire agreement between the Company and you, and supersede all previous written or oral agreements between the Company and you.  No action (or inaction) by the Company may be construed as a waiver of this Policy (or any part).  If any of the provisions of this Policy are held to be unenforceable by a court having competent jurisdiction, the remainder of this Policy will continue in full force and effect.

 

 

Law Enforcement

 

The Company fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities. The Company reserves the right to release information to law enforcement agencies about a user in the following instances: (1) the Company believes such users are in violation of this Policy, (2) as required by law, (3) when the user is engaging in any activities that the Company in its sole discretion believes to be unlawful and the identity of those who may be responsible, (4) when we believe disclosure is necessary to prevent physical harm or financial loss, or (4) in connection with an investigation of suspected or actual illegal activity.
